SO YOU THINK YOU GOT A LEMON?

Congratulations! You have just paid $30,000.00 for your brand new dream car which you saved up two years to buy. It is beautiful! Special paint, chrome wheels, leather interior, upgraded engine, the works! For the first couple of weeks, you proudly showed off your gem to all of your family, friends, and co-workers. For the first nine months, your car ran like a dream. Everything was perfect - and then, after putting 8,000 miles on your car, your nightmare began.

SO YOU THINK YOU GOT A LEMON? GUESS WHAT? YOU PROBABLY DO - AND YOU'VE GOT RIGHTS!

Californians are fortunate enough to have an excellent consumer protection law called the "Song-Beverly Consumer Warranty Act," more commonly known as the "Lemon Law" which affords California consumers the right to take legal actions against manufactures of defective vehicles.

SQUEEZING THE LEMON OUT OF THE LEMON LAW

The California Lemon Law is a great consumer-oriented law giving California consumers the right to return their defective vehicle to the manufacturer, for a full or partial refund, when their vehicle cannot be properly repaired after a reasonable number of attempts.

I guess there is something in the air this time of year that possess some automotive dealerships to try to take advantage of their most important asset - you, the consumer. Lately, we have seen a wide variety of dealership misconduct. For instance, one local dealership sold our client a "Certified pre-owned vehicle" which had allegedly passed a vigorous inspection for safety, reliability, and quality. However, after the vehicle was purchased, it was later learned that the vehicle had been in a serious accident, was illegally modified, was unsafe, and was sold for thousands of dollars more than the vehicle's true value. The dealership refused to cooperate with requests to take back the vehicle.

THE PERFECT CONSUMER APPROACH TO BUYING THE PERFECT CAR

We receive many calls at our office by people who have made expensive new or used vehicle purchases only to find out later that they purchased a lemon or a flawed vehicle which was far less in value than they bargained for. For example, one of our clients purchased a used vehicle from a used car lot. It was a "perfect" car with low mileage. After the purchase, however, he found a vehicle rental receipt behind a seat which proved that his vehicle was not only a previous rental vehicle, but the odometer had been rolled back 30,000 miles! Be assured that undoing a vehicle transaction is not for the simple minded, or those with weak stomachs.
