Are Vehicles Purchased from a Private Party Afforded Lemon Law Protection in California?

There’s always been a burning question on lemon law cases whether or not a vehicle purchased from a private party is afforded lemon law protection in California. The answer is now officially, NO! Under Dagher vs. Ford Motors, the Court determined that a consumer who purchased a vehicle from a private party is not entitled to protection under the California lemon law.

A consumer may still be entitled to protection under the Federal laws, but with more restrictive remedies. Therefore, if you’re going to buy a vehicle from a private party, even if the vehicle still has the original warranty on it, understand that if it’s a lemon, California law will not protect you! This is just another reason why we always encourage consumers to only buy used cars from reputable dealerships.
